Allison Wright Translations is the name that I, Allison Wright, operate under as a sole trader (trabalhador independente) duly registered under Portuguese law on 15 December 2008 as carrying out the service provision activities of translating and editing. As an independent professional translator, I value the trust and confidence of my clients, suppliers and visitors to my website. This Privacy Policy outlines when, what and why personal data is collected, how it is used and stored. This Privacy Policy should be read in conjunction with the Cookie Policy of Automattic.com used by WordPress, the domain hosts of Allison Wright Translations.

As regards my direct relationship with you as a client or potential client, I am considered a Data Controller in terms of Regulation (EU) No. 2016/679 on General Data Protection (“GDPR”) and, as such, you may contact me at any time concerning your personal data via allisonwright@allisonwrighttranslations.com.

Data Collection and Categories of Data

The lawful basis for processing your data is to perform translation, editing or related services that you request, or to assess work to be performed, as well as to comply with legal requirements.

A contact form has been provided on my website to make it easier for you to contact me if you are looking for information or a quote for translation services. Using the contact form on this website, however, is optional.

Naturally, some personal data has to be collected in order to establish communication.

Only personal data required for the purposes of providing a quotation for the translation or editing or related services you need, and essential data required to comply with legal requirements will be requested or stored.

Such data may include your name, postal address, e-mail address, telephone number, tax identification number and any other information which may be contained in the documents you furnish which are necessary for me to provide the agreed services.

No data will be collected for marketing purposes nor do I send out any mass e-mails in that regard. Your personal data shall not be transmitted to any third party without your prior written consent.

Data Subjects

Data is stored on clients, suppliers, data processors and potential clients for legitimate interests.

Retention of personal data

Personal data collected shall be retained for the length of time stipulated below to comply with reference, legal and tax requirements.

Data collected for the purposes of preparing quotations shall be stored for 12 (twelve) months. Translations shall be stored on a hard drive for 2 (two) years and translations destined for certification by a notary public, a hard copy of which is kept on file, shall be stored for 5 (five) years. Personal data collected for the purpose of issuing invoices and receipts on which VAT is levied shall be stored for 10 (ten) years, per statutory requirements. The respective data shall be deleted once the aforementioned time periods have lapsed.

Confidentiality

Any and all correspondence between my clients and/or suppliers and I regarding translations or related work, and documents, names, contents and other information provided by clients and suppliers shall be kept strictly private and confidential, without prejudice to my right to, directly or indirectly, assert my rights as regards any issues or disputes arising from work performed, and without prejudice to the validity of any pre-existing Non Disclosure Agreement or Confidentiality Agreement I may have signed.

Third party access

Should I work in collaboration with a professional colleague to proofread or revise work relating to the professional services I provide, your personal data not essential to the understanding of the documents concerned shall be rendered anonymous or removed prior to being forwarded to said colleague. Any third party subcontracted by me for the purposes of proofreading or revision shall expressly agree to this Privacy Policy prior receiving the work and shall undertake to maintain professional secrecy and confidentiality with regard to any aspect of the information contained in your documents, including any personal data that may be extrapolated from other content in the documents received by the said third party.

Any information accompanying payment for professional services rendered by my bank (Millennium bcp) is subject to the bank’s privacy policy summarised in English. In the event of any dispute the original Portuguese version shall be applicable in law.  Within the scope of their duties, they may have access to some of your personal data, such as your name and taxpayer number when funds are transferred to my account. By confirming your order for services provided by Allison Wright Translations, you automatically agree to Millennium Bank processing any of your personal data required to effect a payment transaction.

Any personal data required by the Portuguese taxation authority for the purposes of income tax declarations and Value Added Tax (VAT) declarations shall be given in the strictest confidence an in compliance with the aforementioned Regulation (EU) No. 2016/679 on General Data Protection.

Data is collected by my website (hosted by WordPress) and e-mail (hosted by Google G-Suite) are GDPR-compliant.

Your rights

All necessary measures have been taken to ensure the ongoing confidentiality, integrity and security of your personal data, in compliance with GDPR.

You are ensured of your right of access and objection to and the rectification, restriction and erasure of personal data stored, pursuant to GDPR. Should you wish to exercise any of these rights, please send me an e-mail in this regard and I will respond to your request within fifteen days at the most, barring any unforeseen circumstances.

Security measures

All possible precautionary measures are taken to ensure that your personal data is protected.

The most up-to-date internet security is installed on the computers which process and store your personal data. The suite includes anti-virus software, ransomware protection a firewall, web, file and app protection and other features, which are all in place to prevent unlawful third-party access. The Internet Security Suite is regularly and automatically updated.

Computers also have malware software installed to prevent against data loss and theft, which is also regularly and automatically updated.

Translation work is backed up onto a hard drive which is stored in a secure location. The original work on my computer is securely deleted you, my client, have confirmed receipt and that all is in order. Translation work is also stored on One Drive Cloud, in the event I need to refer to any work to clarify client needs on the go. To this end, the Data Processing Amendment to G Suite has been accepted to ensure GDPR compliance.

All computers and electronic devices used to access, store or process personal data have technical measures implemented to ensure the protection thereof, that is, they are password protected.

Personal data breach

In the event of a personal data breach, as a result of theft or unlawful access for example, the Portuguese Data Protection Authority (CNPD) will be notified within 72 hours of such breach. Said notice will include the nature of the breach, actions taken and possible consequences thereof. I will also notify you immediately of any breach.

Cookie Policy

Most websites use cookies to collect data. Mine is no exception. Cookies are small data files that are stored on your computer or electronic device while you browse and are designed to make navigating the internet more convenient and efficient. They personalise your experience and analyse site usage, they are not there to collect sensitive data.

This Privacy Policy was updated on 25 May 2018 and will be reviewed as deemed necessary. Should there be any discrepancies between the Portuguese and English language versions, the version in English shall prevail.
